Terms of Service

Article 1 - Definitions
FlightMoneyBack.eu: trading name of Twilper, sole proprietorship, established at Merelstraat 64, 8916 AX Leeuwarden, Netherlands (KvK 98440217, VAT NL005332508B94).
Customer / Passenger: the natural person who authorises FlightMoneyBack.eu to submit a claim under Regulation (EC) 261/2004 on his/her behalf to an airline.
Compensation: the amount the airline must pay under EU261/2004 (€250-€600 per passenger).
Commission: one all-in success fee of 25% of the compensation actually paid by the airline. Applicable taxes are included; the consumer never pays more than 25%.
Article 2 - Applicability
These terms apply to all services between FlightMoneyBack.eu and the Customer. By registering and granting the digital power of attorney, the Customer accepts these terms in full. Deviations only apply if agreed in writing.
Article 3 - Services
FlightMoneyBack.eu provides the following services on a no-cure-no-pay basis:
- Assessment of whether a flight entitles you to compensation under EU261/2004;
- Drafting and sending a claim letter to the airline;
- Tracking correspondence and sending a neutral reminder when no response is received;

- Court proceedings, baggage claims and consequential losses are outside this agreement.
Article 4 - Power of Attorney
The Customer grants FlightMoneyBack.eu a digital power of attorney (authorisation) to correspond in his/her name with the airline and third parties regarding the claim. The power of attorney includes:
- Submitting the claim on behalf of the Customer;
- Receiving and answering correspondence from the airline;
- Preparing escalation to a previously reviewed national enforcement body or ADR entity;
- Access to passenger data necessary for processing.
The power of attorney can be withdrawn by emailing legal@flightmoneyback.eu. After withdrawal, a success fee remains due only on an actual payout covered by the agreement, without limiting mandatory consumer rights.
Article 5 - Fee (Commission)
- The compensation will be paid by the airline directly to the Customer's IBAN as provided by the Customer.
- The Customer is obliged to confirm receipt of the payment to FlightMoneyBack.eu within 7 days of receipt, via the dashboard.
- Before dispatch, the Customer saves a payment method with Stripe. Nothing is charged at that time. Stripe stores the payment details; FlightMoneyBack.eu does not receive full card or bank account details.
- FlightMoneyBack.eu may collect the 25% all-in success fee only after the Customer confirms the actual payout and amount received in the dashboard.
- No success fee is collected without a confirmed payout. A formal airline award is not evidence that the Customer has received the funds.
- Bij volledige weigering of uitblijven van een airline-uitbetaling is geen commissie verschuldigd ("no cure, no pay").
Article 6 - Customer Obligations
The Customer undertakes to:
- Provide accurate and complete data (flight number, date, IBAN, name and address);
- Not submit a parallel claim through another service provider;
- Report receipt of payment within 7 days via the dashboard;
- After a payout, provide accurate information and cooperate with the agreed settlement, while retaining statutory consumer rights;
- Forward any additional communication from the airline to claims@flightmoneyback.eu.
Article 7 - Liability
FlightMoneyBack.eu does not guarantee an outcome. The assessment depends on flight facts, evidence, the airline and, where relevant, a competent enforcement body or ADR entity. Mandatory consumer rights and liability that cannot lawfully be limited remain unaffected.
Article 8 - Right of Withdrawal
As a consumer, the Customer generally has a 14-day right of withdrawal. Services may start during that period only at the Customer's express request. The right is lost only after full performance and the prior consent required by law; an earlier withdrawal may result only in a proportionate payment permitted by law.
Article 9 - Privacy
Personal data is processed in accordance with the Privacy Statement. FlightMoneyBack.eu only processes data necessary for carrying out the claims procedure. Privacy
Article 10 - Complaints
Complaints can be submitted via klachten@flightmoneyback.eu. FlightMoneyBack.eu will respond within 14 days. Complaints
Article 11 - Applicable law and disputes
Dutch law applies to the agreement without prejudice to mandatory consumer protection in the Customer's country of habitual residence. A consumer may use any competent court available under applicable consumer law.
Article 12 - Miscellaneous
FlightMoneyBack.eu may amend these terms. The version in effect at the time of the authorisation agreement shall remain applicable to that specific claim.
